Sexual Offenses

Sexual offenses are classified as high-impact crimes within the Mexican criminal justice system. They are considered particularly sensitive due to their social gravity, the psychological harm they may cause, and the fact that, once the Public Prosecutor’s Office (Fiscalía) becomes aware of a potential commission of such an offense, it is legally required to investigate ex officio, without the complainant’s consent to continue the process.

This means that even if the person who initially made a statement later recants or elects not to pursue the accusation, the prosecuting authority is not legally empowered to abandon either the investigation or the criminal proceedings. As a result, the accused must face an investigation and, in many cases, a criminal trial, with no possibility of termination at the will of the accusing party.
