How to find out what crime my family member is accused of in Mexico
One of the most stressful moments for a family is not knowing exactly what crime their relative is being accused of. In Mexico, this information is not always given immediately or clearly by the police or even by the prosecutor’s office in the first hours.
Knowing the precise legal name of the crime is essential because the possible penalties, the type of preventive measures, and the defense strategy all depend on the formal accusation. A general description such as “drugs” or “violence” is not enough for a proper legal defense.
Ways to find out the formal accusation
- Ask at the prosecutor’s office where the person was presented. Request the investigation file number and the legal classification of the facts.
- Speak with the assigned prosecutor (Agente del Ministerio Público). They are the ones who formally determine the crime that will be charged.
- Attend or monitor the initial hearing (audiencia inicial). During this hearing the prosecutor must clearly state the crime being charged before the judge (Articles 307-309 of the CNPP).
- Request access to the investigation file through a licensed criminal lawyer. Only authorized people can review the full content of the file.
Legal Framework
The Código Nacional de Procedimientos Penales regulates the formulation of the imputation (Article 309). The prosecutor must communicate to the imputed person, in the presence of the control judge, that an investigation is being conducted against them regarding one or more facts that the law defines as a crime. Article 20 of the Mexican Constitution guarantees the right of the accused to be informed of the nature and cause of the accusation. Article 18 of the CNPP requires authorities to ensure that the person knows their rights.

Many times the police only give a general idea of the reason for the arrest. The formal charge that the prosecutor later presents can be different and sometimes more serious.
