How soon must an arrested person appear before a judge in Mexico
In Mexico, an arrested person cannot be held indefinitely without judicial control. The law establishes clear time limits for the first appearance before a judge. This first judicial control is one of the most important moments in the entire criminal process.
The purpose of this rule is to prevent arbitrary detentions and to guarantee that a judge reviews the legality of the arrest as soon as possible.
Legal time limits
In most cases, the prosecutor has a limited number of hours to present the detained person before a control judge (juez de control). This first hearing is called the initial hearing or audiencia inicial.

Legal Framework
The Código Nacional de Procedimientos Penales regulates the initial hearing in Articles 307 to 309. Article 308 specifically addresses the control of the legality of the detention. Immediately after the detained person is placed at the disposal of the control judge, the initial hearing must be held to review the detention before the formulation of the imputation. Article 16 of the Mexican Constitution establishes the right not to be deprived of liberty except under the conditions authorized by law. Article 20 protects the rights of the accused, including the right to a prompt judicial review.

What happens at the initial hearing
At the initial hearing the judge will typically verify if the arrest was legal, listen to the prosecutor’s accusation, hear the arguments of the defense, decide if there is enough evidence to continue the criminal case, and determine whether the person can be released with protective measures or must remain in preventive detention.
