- In crimes that are prosecuted only by complaint of the victim (delitos de querella), the withdrawal can lead to the closing of the investigation.

When withdrawing the complaint does NOT end the case
- In crimes that are prosecuted automatically by the State (delitos de oficio), the prosecutor can continue the case even if the victim withdraws.
- Serious crimes such as certain types of violence, drug-related offenses, or weapons offenses usually continue regardless of the victim’s wishes.

The distinction between delitos de querella and delitos de oficio is fundamental in Mexican criminal law. The Código Nacional de Procedimientos Penales and the corresponding criminal codes establish which crimes require a formal complaint from the victim to proceed and which ones the State can prosecute on its own initiative. Article 20 of the Mexican Constitution protects the rights of both the accused and the victim. The prosecutor retains the power to continue the investigation in many cases even after a withdrawal.
